Location: 1330 Jolly Lane, located at the northern terminus of Jolly Lane, Section 3, T1N, R8E, Rapid City.

Agenda Title:

Request from Architecture Incorporated for Children’s Home Society of South Dakota for a Variance to Waive the Requirement to Install Sidewalk Along Jolly Lane for the property at 1330 Jolly Lane per City Ordinance 12.08.060.

Summary:

A request was received in the Engineering Office on September 4, 2014 requesting the requirement to install sidewalk per City of Rapid City Ordinance 12.08.060 be waived. A 5 foot sidewalk is required to be constructed along Jolly Lane. The requested variance will allow for construction of a parking lot expansion and a change in use in a portion of the property without the installation of sidewalk in the adjacent right-of-way. Adjacent Jolly Lane is a commercial street with curb and gutter, and sidewalk on only the neighboring property to the southwest. Along this portion of Jolly Lane the east side of the road is developed as single family residential located in Pennington County and the west side of the road is undeveloped located in Rapid City. As the west side of the road develops, sidewalk would be required to be constructed along the west side of Jolly Lane, creating a pedestrian corridor the entire length of the street.  This property would contribute to that pedestrian corridor. Some grading work and two sidewalk bridges are needed to construct the curbside sidewalk on this property east of the driveway approach. This property has approximately 200’ of frontage requiring sidewalk along Jolly Lane, with approximately 70’ of frontage west of the driveway approach and 130’ of frontage east of the driveway approach. Constructing the sidewalk east of the driveway approach provides a pedestrian corridor to the property.

Recommendation:

Action: Choose an item. Require sidewalk construction from the west property line to the driveway approach and require a waiver of right to protest be signed for the future installation of the remaining sidewalk improvements from the driveway approach to the east property line.
